On August 26, 2008, a 30 year old man was operating his motor vehicle in Fairfield, Connecticut, when his vehicle was struck by a van that was owned by the defendant, which was exiting a driveway of the defendant’s business. As a result of the accident, the plaintiff sustained a large recurrent herniated disc at L5-S1 and was caused to undergo surgery on his back involving a decompression laminectomy at L5, excision of the recurrent disc hernation at S-1 and spinal fusion at L5-S1. Suit was instituted in Bridgeport Superior Court against the owner and operator of the van and the case settled for $245,000.00 at the trial management conference shortly before trial.
