$1,375,000.00 Settlement for a 44 Year Old Man Who Sustained a Failed Back Syndrome After Falling on Ice Inside a Parking Garage at Work
On March 19, 2013, a 44 year old man had parked his truck inside an employee parking garage at work when he stepped out of his truck and was caused to slip and fall on a large patch of ice that was located on the floor of the parking garage, directly underneath his truck, causing his feet to go out from underneath him and further causing him to strike his back on the step of his truck, which caused him to sustain severe injuries. Claims of negligence were made against the owner of the parking garage for failure to make repairs to the parking garage when they knew, or should have known, that water was leaking inside the parking garage, for failure to warn the plaintiff of the dangerous and defective condition of the parking garage and for their failure to apply sand or salt to the area inside the parking garage, among other claims. As a result of the accident, the plaintiff sustained a herniated disc in his back at L3-4, causing him to undergo three back surgeries, including a discectomy, a spinal fusion and the installation of a spinal cord stimulator in order to alleviate his back pain. The plaintiff was also subsequently diagnosed with failed back syndrome. As a result of this accident, the plaintiff ultimately lost his job at work and had to undergo re-training in order to perform a different job where he will earn less money than he did before the accident. Suit was instituted in Hartford Superior Court and the case settled a few weeks prior to trial following a mediation with a Superior Court judge for the sum of $1,375,000.00.
