What is “Negligent Security”?
Negligent security is the area of the law that concerns claims against persons or businesses that fail to provide adequate security at property they own, manage or control when a person is a victim of a criminal attack while on the property.
Who Would be Entitled to Bring a Negligent Security Claim?
If you were injured while on the property of another person as a result of a criminal attack, you may be qualified to bring a negligent security lawsuit. If the property or surrounding area has a history of criminal activity and the property owner knew or should have known that someone could be assaulted while on the property, the owner or manager of the property may be held liable for the victim’s injuries.
It is not uncommon for these types of claims to stem from acts of violence occurring within, or just outside of nightclubs and bars. The law requires these types of businesses to have reasonable safety features and personnel to prevent injuries caused by attacks on their customers. If you were injured due to an act of violence while inside a commercial establishment and there was no reasonable security present you may be entitled to compensation. Other common locations where these types of events happen are hotels, shopping malls, parking lots, apartment complexes, and any business in a high-crime area.
What Should I do if I am the Victim of a Criminal Attack?
If you have been the victim of a criminal attack while on someone else’s property, you should immediately report the incident to the police so that they can apprehend the criminal as well as document your claim. You should also immediately seek medical attention for any injuries that you sustain. In addition, you should consult with an attorney who is experienced in handling these types of claims in order to determine whether or not you have a potential case.
