Arbitration Award of $46,200.00 for 7 Year Old Girl Who Was Injured When She Put Her Arms Through a Glass Door in a Trailer
On July 18, 2008, a 7 year old girl was playing in a trailer with her siblings and other children which was located on the defendant’s property in Winsted, Connecticut, when she was caused to put both of her hands through the window of the trailer after she had been locked in the trailer by one of the other children, causing her to sustain severe lacerations to both wrists as well as neuropathy and thenar atrophy of the right hand. Suit was instituted in Litchfield Superior Court against the defendant property owner for failure to supervise the minor plaintiff and for allowing the minor plaintiff to play in the trailer when the defendant knew or should have known that it was not reasonably safe to do so. The defendant was insured by Allstate Insurance Company. Prior to trial, the parties agreed to proceed to a binding high/low arbitration. Following a contested hearing before an arbitrator, the arbitrator subsequently awarded the plaintiff and her mother the sum of $46,200.00.
