What is Products Liability

Products Liability is the area of the law that deals with defective products. If you sustain an injury as a result of a defective product, you may be entitled to make a products liability claim.

What is the Law in Connecticut on Products Liability Claims

Connecticut law provides that if a person is injured as a result of a defective product, he or she can institute a lawsuit against the product seller. “Product Seller” has been defined under Connecticut law as a “person or entity, including a manufacturer, wholesaler, distributor or retailer… engaged in the business of selling such products whether the sale is for use or consumption”. The term “Product Seller” also includes lessors or bailers of products engaged in the business of leasing or bailment of products.

A product has been defined by the courts as “any item, thing, or commodity, which, upon acquiring its physical existence and identity, through the process of manufacture or otherwise, is put in the stream of commerce either by sale, for use, consumption or resale or by lease or bailment.”

Examples of the types of products that would be covered under the Products Liability Act would include, but are not limited to, motor vehicles, tools, toys, machinery, candles, furniture, firearms, food, chemicals, drugs, medical devices, appliances, among other products too numerous to mention.

A product can be defective in one of two ways. Either the product suffers from a design defect, in that all types of that product suffer from the same defect due to the way in which they were designed or a manufacturing defect, in that that specific item was defective for some reason. Regardless of the type of defect, if you were injured due to the use of that product you may be entitled to monetary compensation.
